Sport Image Subscription Terms and Conditions

When you sign-up for a sport image subscription there are terms and conditions applicable, in addition to the general terms and conditions:

By signing-up to a sport image subscription you are subject to and agreeing to abide by the general terms and conditions, the personal use licence agreement and the terms and conditions listed below:

  1. All images provided are a personal use licence; only for personal use by you. Images must not be used commercially, advertising, press/media, third party, derivative, club or any other use without prior permission and the applicable licence. Images supplied are subject to a personal use licence agreement, which you are agreeing to adhere to by taking out the image subscription.
  2. Images supplied as part of your subscription will be a mix of colour or monochrome (black and white) – it is entirely at the discretion of the photographer which images are created for an image delivery. There is no right to reject on the basis of style or composition.
  3. The personal use licence allows you to post the images on your personal social media and/or print.
  4. You should provide credit to the photographer and link out to the appropriate social media or website when posting online.
  5. Images supplied are of an individual player/athlete only (ie not others who do not have a sport image subscription).
  6. You may use images for physical photographic prints and photobooks, but only for personal use. You may not resell images or products using the images.
  7. You may not supply or transfer the images to others. Images are solely for your use, as part of the personal image licence.
  8. You may not supply or transfer the images to other artists or designers for use in derivative or AI work. Separate image licences are available upon request for derivative/AI work.
  9. Images must not be supplied to or transferred to your club, federation, governing body or press/media for any use. Separate image licences are available for these purposes, upon request.
  10. You understand that you do not own the copyright in the images purchased via the subscription; copyright remains with the photographer, Andrew Cooper Photography, at all times throughout the world.
  11. The minimum term for your subscription is 12 months from your first payment.
  12. You must provide 30 days notice if you wish to cancel your subscription, which you must do by contacting us via email or the sport image subscription contact page – more details below in the payments section.
  13. Where Andrew Cooper Photography no longer wishes or is able to provide images to you as part of your subscription, you will be given 30 days notice that the subscription is ending (all image subscription payments/order will be honoured up to the point where the subscription ends).
  14. Andrew Cooper Photography reserves the right to alter or amend any products or services as part of the sport image subscriptions. As such all sport image subscription packages evolve over a period of time to improve or adapt the included products and offers, so are subject to change or variation without prior notice. Any current subscribers affected by any changes to sport image subscription packages/plans will be notified, including options available to them.
  15. Prices are correct as at the time of you signing-up to your chosen image subscription package. Prices are periodically subject to change and you will be notified 30 days prior to any price change, with the option to cancel your subscription (without penalty) if you do not wish to continue your subscription at the amended pricing.

Sport Image Subscription Payment Terms

  1. All payments for image subscriptions are via a direct debit – you will be emailed with the direct debit mandate request, usually within 72 hours of you signing-up for a subscription. Please complete this direct debit mandate to finalise and start your subscription; you will need your bank details (sort code, account number); I do not see nor store these bank details.
  2. The direct debit mandate usually takes 7-10 working days to initially be set up with your bank and for the payments to be started.
  3. Payments are triggered via a monthly or quarterly invoice, from accounting software to the direct debit payment processor (Go Cardless).
  4. You will receive your image (via the digital download link) within 14-21 days (often sooner) of each of your direct debit payments.
  5. Where you opt for quarterly image subscription, you will receive your image (via the digital download link) within 14-21 days (often sooner) of each of your third quarterly direct debit payments.
  6. Payments must continue for your sport image subscription. Where a payment fails then you will be contacted to re-start the direct debit payments and/or where necessary re-authorise your direct debit mandate so that further payments can be taken for your sport image subscription.
  7. Where no reply or response is received to emails regarding failed direct debit payments, then the sport image subscription will be deemed to have been cancelled on the payee’s part. The balance of any subscription period payments will be due.
  8. There maybe administration charges (£15 for re-setup of the direct debit mandate request etc.) for any failed payments.
  9. Where there are more than two failed payments via the direct debit, then the subscription will be deemed to have been cancelled on the payee’s part. The balance of any subscription period payments will be due.
  10. If you wish to cancel your subscription, you may do so after your minimum subscription period (usually 12 months from your first payment). You will need to give 30 days notice that you wish to stop your subscription; you should notify me via email and I will confirm the cancellation and final payment date accordingly.
  11. Where you cancel your direct debit without 30 days notice and/or without informing me, then any outstanding payments from your subscription will still be due and you will be invoiced accordingly.
  12. Where you cancel your direct debit prior to your minimum subscription period, the balance of your minimum subscription period will still be due and you will be invoiced accordingly.
  13. Payments are not refundable.

Receipt of your images as part of your subscription.

  1. You will receive your image (via the digital download link) within 14-21 days (often sooner) of each of your direct debit payments.
  2. Where you opt for quarterly image subscription, you will receive your image (via the digital download link) within 14-21 days (often sooner) of each of your third quarterly direct debit payments.
  3. Images are delivered via a third-party file delivery system; you will have 7 days to download the file from the link emailed to you.
  4. You should click on the link in the email to download the folder with your images contained within.
  5. The image files may be large, as they are high resolution images, so you need to keep this in mind when downloading and storing the images.
  6. There is no right to reject any images received as part of your subscription, on the basis of style or composition. Images may be colour or monochrome (black and white) and the style and composition of any image is at the sole discretion of the photographer.
