Trading with Andrew Cooper Photography is subject to terms and conditions. By trading with Andrew Cooper Photography and/or use of this website you are deemed to have agree to and will abide by these terms and conditions.
Andrew Cooper Photography is a trading name of Andrew Cooper
Client refers to the customer of Andrew Cooper Photography.
Copyright and Digital Files
Supplied digital files remain the copyright property of the photographer. Andrew Cooper Photography allows the client to store/share/copy/print all images for personal/friends/family use only, subject to no commercial or financial gain.
Buy purchasing an image/s you do not own the copyright, unless agreed in writing and the variation to standard usage terms.
Licences
Personal and Editorial licences are the default, but vary on the image usage, territory, print or web.
For commercial usage licences or advertising and merchandising licences, you may only use the specified licenced images for the number of uses and territories or types of publication/usage.
You may only use an image as licenced to you.
Andrew Cooper Photography images may be widely available and in use on the internet, social media etc.. You are not permitted to share or use these without permission and/or an applicable image licence for you.

Image Use
Andrew Cooper Photography shall grant limited image use, subject to the type of licence issued. All images are copyright of Andrew Cooper Photography. The use of any image is granted by and may be withdrawn by Andrew Cooper Photography.
Individuals, businesses or organisations may only use images they wish following permission and/or an appropriate image licence.
Where there is any abuse of image use, or any unacceptable abusive behaviour, language or threats, then the use or sharing of any images created by Andrew Cooper Photography is prohibited, including any images provided by an image licence. Permission will also be withdrawn for any use of any images created by Andrew Cooper Photography, to be published in any form, whether online, social media, print etc..
Take down notices and any applicable charges may be levied in such circumstances.
Any attempt to steal, download or resale images will result in civil action for damages for each image. Reselling or threats to steal and resell images will result in the use of any previously provided images being withdrawn; take down notices will be issued for any images currently in use.
Artistic License
Andrew Cooper Photography shall be granted complete artistic license including in relation to the poses photographed and the locations used. The photographer(s)’ judgement regarding the style, locations/poses and number of images taken shall be final. Due to the unpredictable nature of the weather and/or the willingness of subjects it may not be possible to capture all the images requested.
Display
The client hereby allows the Andrew Cooper Photography to display any images included in this contract in their studios, portfolios, literature, wedding exhibitions and direct/indirect advertising.
Limitation of Liability
In the unlikely event that Andrew Cooper Photography is unable to perform to the guidelines of this contract due to an injury, illness, act of God, act of terrorism, or other cause beyond the control of Andrew Cooper Photography , then we will make every effort to secure a replacement. If the situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received for the contracted event.
In the unlikely event that digital files have been lost, stolen, or destroyed for reasons beyond Andrew Cooper Photography’s control, including but not limited to camera, hard drive, or equipment malfunction, Andrew Cooper Photography ’s liability is limited to the return of all payments received for the contracted event. The limit of liability for a partial loss of originals shall be a prorated amount of the exposures lost based on the percentage of total number of originals. Andrew Cooper Photography is not liable for the loss of images beyond the lesser of the final delivery of all products included in the package or one year. Neither party shall be liable for indirect or consequential loss.
Payment
Payment for portrait session/s is required at the time of booking unless otherwise agreed prior to the booking being made.
Where payment is not taken at the time of booking, the payment is required to confirm the portrait session prior to the portrait session taking place. The potraiture session booking is not considered firm until full payment has been received.
Where other payment terms have been agreed, a course booking confirmation via email is considered as the course booking and considered firm thereafter.
Where purchase orders are used, a purchase order must follow within 5 (five) working days of the course booking confirmation email. In these circumstances, the course booking confirmation email remains the course booking confirmation.
Please ensure payment is made within agreed terms.
We reserve the right to claim statutory interest at 8% above the Bank of England base rate for late payment in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.
An administration charge of £15 (fifteen) will be levied for each reminder issued for an outstanding invoice.
Where further action is required for late payments all costs associated will be levied to the individual, company, business or organisation named on the invoice
Complaints
Any complaints should be raised by the client with Andrew Cooper Photography , in writing, within 28 days of first becoming aware of the matter to be complained of and in any event within 28 days of receipt of the images.
Force Majeure or Act of God
The due performance of this contract is subject to alteration or cancellation by either party owing to any cause beyond their control
Revisions to terms and conditions
Occasionally terms and conditions are amended. The amendment date is reflected on the terms and conditions.
Governing Law and Jurisdiction
These terms and conditions are subject, and all contractual and non contractual matters arising out of it, shall be governed by English law and shall be subject to the exclusive jurisdiction of the English courts to which the Parties submit.
